Historically, the Afghan legal system has been classified as a written or Romano-Germanic (Civil Law) legal system, and its civil, criminal, and other codified laws have been influenced by the legal models of continental European countries and certain countries in the region. Alongside formal and codified laws, Islamic jurisprudence, particularly Hanafi fiqh, and, in certain areas, local customary practices have also played a role in Afghanistan’s legal structure. Therefore, the Afghan legal system can be characterized as having elements of legal pluralism.
